To finalise any compensation payable to Serco Operating Ltd with respect to loss of income in relation to the closure of Leisure Centres – decision delegated to the Cabinet Member (Finance, Property and Assets)  in consultation with Section 151 officer

Resolved (unanimously):-

1.That Cabinet recommends to Full Council that the future management of the Council’s Leisure Centres be taken back to an in-house management arrangement. This will mean the Council decides not to extend its current leisure management contract with Serco Leisure Operating Ltd at the end of March 2021.

2. Subject to approval by Full Council on the above recommendation, officers will bring a further report to Cabinet as to how the proposed new in-house management arrangement will operate. This will balance the requirement for the council to maintain influence over the borough’s leisure services whilst ensuring the most financially efficient approach is undertaken.

3.     That Cabinet requests that officers continue working with SERCO to finalise any compensation payable to Serco Leisure Operating Ltd with respect to loss of income in relation to the closure of the Leisure Centres and delegates that decision to the Cabinet Member for Health, Wellbeing and Leisure in consultation with the Section 151 Officer of the Council.

Resolved (unanimously): – That the press and public be excluded from the following item of business on the grounds that it involves the likely disclosure of exempt information as defined in Paragraph 3 of Schedule 12A to the Local Government Act 1972.

Decision Made

To approve the appointment of the contractor identified in the confidential report via a waiver for the provision of Project Management (PM) and Quantity Surveying (QS) Services for the Worden Hall Refurbishment and McKenzie Arms Development.

Reasons for Decision

To ensure both schemes are delivered on time and on budget to an acceptable standard.

Because the resources to deliver the required PM and QS services are not available in-house.

Alternative Options Considered and Rejected

To undertake a competitive tendering exercise for delivery of the services. This option was rejected as it would jeopardise delivering the schemes within the agreed programme.

That

1.    expenditure up to £40,000 from the Council’s allocated Capital budget to enable repairs and maintenance at the Churchyard at The Parish Church of St Mary’s Penwortham, Church Avenue, Penwortham be approved; and

2.    the Closed Churchyard Management Policy, attached as Appendix 1, be approved.

1.    members are minded to approve the application; and

2.    the decision be delegated to the Director of Planning and Development in consultation with the Chair of Planning Committee upon the successful resolution and removal of the outstanding objection by the Environment Agency.

That the application be refused for the following reasons:

1.    due to the increase in traffic flow adjacent 365 Brindle Road and the resulting amount of traffic, associated traffic noise and type of traffic, this would have a detrimental impact on the residential amenity of the occupants of that neighbouring properties contrary to Policy B1 criteria c) in the South Ribble Local Plan; and

2.    the proposal introduces an industrial building with associated parking and access, a large expanse of blacktop and encloses the site with substantial 2.4m high fencing into what was a residential garden within a residential area. This is considered to be detrimental to the character and appearance of the area, contrary to Policy G17 in the South Ribble Local Plan.

RESOLVED: (For: 7 Against: 4)

That the application be refused because the proposed development by virtue of its size, scale and location would have a detrimental impact on the openness of the Green Belt and the purposes of including land within it and the very special circumstances offered by the applicant are not considered to outweigh the harm. The proposal is therefore contrary to Policy G1 in the South Ribble Local Plan.
