Resolved (Unanimously) that Councillor Clare Hunter be appointed the Chair.

4.

Exemption of Public and Press

To consider the exclusion of the press and public for the following items of business on the ground that it involves the likely disclosure of exempt information as defined in Paragraph 1, 2 and 4 of Part 1 of Schedule 12A to the Local Government Act 1972.

 

By Virtue of Paragraph 1: Information relating to any individual.

Condition:

Information is exempt to the extent that, in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

Information is not exempt if it relates to proposed development for which the local planning authority may grant itself planning permission pursuant to Regulation 3 of the Town & Country Planning General Regulations 1992(a).

 

By Virtue of Paragraph 2: Information which is likely to reveal the identity of an individual.

Condition:

Information is exempt to the extent that, in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

Information is not exempt if it relates to proposed development for which the local planning authority may grant itself planning permission pursuant to Regulation 3 of the Town & Country Planning General Regulations 1992(a).

 

By Virtue of Paragraph 4: Information relating to any consultations or negotiations, or contemplated consultations or negotiations, in connection with any labour relations matter arising between the authority or a Minister of the Crown and employees of, or office holders under the authority.

Condition:

Information is exempt to the extent that, in all the circumstances of the case, the public interest in maintaining the exemption outweighs the public interest in disclosing the information.

Information is not exempt if it relates to proposed development for which the local planning authority may grant itself planning permission pursuant to Regulation 3 of the Town & Country Planning General Regulations 1992(a).

Appeal Against Dismissal During Probation Management Case

Chris Moister, Director of Governance presented the Dismissal During Probation Management Case and questions were asked.

 

The grounds of the appellant’s probation was highlighted, with the objectives the role was expected to achieve. At the six month probation review, there was insufficient evidence of the delivery of the priorities and objectives and the probation period was extended, with narrowed priorities and increased frequency of probationary meetings.

 

The decision to dismiss the appellant was made, and delivered 7 September outlining the reason for dismissal and the right to appeal.

Appeal Against Dismissal During Probation Statement Case for the Appellant

Minutes:

The appellant (and their Unison Representative) made their statement case and asked questions based on the view that:

·         the outcome was too severe,

·         the decision – in that the evidence presented did not support the conclusion reached.

 

Having fully considered the representations (written and oral), the Committee adjourned at 16:06 and resumed at 16:30.

 

Resolved: (Unanimously) that the decision for dismissal was upheld and found to be reasonable.
