The panel noted that representatives of the police were not present (with permission) because following receipt of the application for review they were satisfied with the steps taken by the Premises Licence Holder in respect of installing CCTV however the police have requested that the conditions (as set out in Sergeant Bushell?s Statement of 15 September 2010 attached to the panel?s papers) be placed on the licence. The Premises Licence Holder confirmed that he had no objection to the conditions being placed on the licence.

With the permission of the panel and in accordance with the council?s hearing procedure, the Licensing Officer introduced the application.

The Premises Licence Holder then addressed the panel and questions were asked.

Having fully considered all the representations (written and/or oral) made by the police and the Premises Licence Holder, the panel retired to reach its decision.

The panel took into account the provisions of the Licensing Act 2003, the guidance issued in respect of it and the council?s own policy document.

The panel felt that the conditions requested by the police would be enough to ensure that the licensing objectives were not undermined.
RESOLVED (UNANIMOUS): that subject to the additional conditions as set out in the schedule below no further action be taken in respect of the premises licence for Darios, 240a Station Road, Bamber Bridge on this occasion.

Licensing Panel on the 22 November 2010 held a hearing in respect of an application from the police for a review of the premises licence for Darios, 240a Station Road, Bamber Bridge, Preston Lancashire PR5 6EA

The police with permission did not attend the hearing but provided a written submission that they were satisfied with the steps taken by the Premises Licence Holder in respect of installing CCTV but asked that the conditions requested in the application form be applied to the licence to ensure promotion of the licensing objectives and ensure future compliance.

The Premises Licence Holder confirmed he had no objection to the conditions being placed on the licence.

The panel considered the papers and the verbal evidence and agreed that the following conditions be placed on the licence:

1. A tamper proof CCTV system will be installed, operated and maintained in liaison with and to the satisfaction of Lancashire Constabulary, the system will record for 24hrs each and every day.

2. There will be, at all times the premises is open, someone at the premises who can operate and download images from the system and provide a copy of these images to any responsible authority at the time of request.
