The panel considered an application for the variation of a Premises Licence submitted under the Licensing Act 2003.

With the permission of the panel and in accordance with the council?s hearing procedure a Licensing Officer introduced the application.

The applicant (accompanied by an Independent Health and Safety Consultant) then addressed the panel and questions were asked.

During the course of the meeting, the panel noted ?

(i) the noise survey and assessment report of the Independent Health and Safety Consultant which was commissioned by the applicant; and
(ii) that the objector was not present at the meeting.

Having fully considered the representations (written) made by the objector and the application made by the applicant, the panel retired to reach its decision.

The panel took into account the provisions of the Licensing Act 2003, the guidance issued in respect of it and the council?s own policy document.
RESOLVED (UNANIMOUS): that the application to vary the premises licence be granted subject to the attachment to the premises licence of the appended permitted hours and licence conditions.

The times for the variation in respect of live music be granted as applied for:

E = Live Music - Indoors Friday ? 20.00 ? 00.00
Saturday ? 20.00 - 00.00
Sunday ? 16.00 ? 20.00

In addition, the following conditions are to be placed on the licence:

1. To prevent noise nuisance to surrounding properties all doors and windows shall remain closed whenever regulated entertainment is being provided although doors may be opened to allow entrance and exit to the premises
