At the commencement of the meeting the Principal Solicitor informed the meeting that there was an error in the original report which had been republished in that it was the barman that was suspected by the police of being under the influence of drugs and not Mr Conde (the former Designated Premises Supervisor (DPS)) as stated.

An amended copy of the report was circulated at the meeting.

The panel noted that representatives of the police and the Premises Licence Holder (Enterprise Inns Plc) were not present because following receipt of the application for review, the Premises Licence Holder applied to transfer the DPS to Mr Richard Thwaite and that both parties agreed the conditions (as set out in Gosschalks Solicitors? letter attached to the panel?s papers) to be placed on the licence.

With the permission of the panel and in accordance with the council?s hearing procedure, the Licensing Officer introduced the application.

Having fully considered all the written representations made by the police and the Premises Licence Holder, the panel retired to reach its decision.

The panel took into account the provisions of the Licensing Act 2003, the guidance issued in respect of it and the council?s own policy document.

The panel felt that the suggestions from both parties would be enough to ensure that the licensing objectives were not undermined.
RESOLVED: that subject to the additional conditions as set out below no further action be taken in respect of the premises licence for Black Bull, 353 Station Road, Bamber Bridge on this occasion.

1. The premises will have in place a written policy, to the satisfaction of Lancashire Constabulary to prevent the sale of supply of alcohol to persons under the age of 18. This policy shall require that any person who does not appear to be at least 21 years of age will not be served alcohol unless they can produce a recognised proof of age card accredited under the Proof of Age Standards Scheme (PASS), photocard driving licence or passport.

2. Notices will be displayed where they can be clearly seen and read in the premises indicating that the premises operates a Challenge Policy in relation to the sale of alcohol.

3. All staff will receive training in relation to age related produce sales, this training will be refreshed on a regular basis, which should at a minimum be two times a year.

4. The premises will maintain written records of all staff training and refresher training. These records will be made available for inspection for any responsible authority on reasonable request.

5. The premises will operate a refusal register to the satisfaction of Lancashire Constabulary. This will be made available for inspection by any responsible authority on reasonable request.
