Review of Premises Licence ? Pleasant Retreat, 2 Watkin Lane, Lostock Hall Report attached. attached Procedure attached Application attached Review Notice attached Representation - Interested Parties attached Representation - Pleasant Retreat attached Premises Licence attached Plan attached The Licensing Panel considered an application by Lancashire Constabulary for a review of a premises licence under Section 51 of the Licensing Act 2003. This application was in respect of Pleasant Retreat, 2 Watkin Lane, Lostock Hall, Preston, PR5 5RD. With the permission of the panel and in accordance with the council?s hearing procedure, the Licensing Officer introduced the application. The Principal Solicitor informed the panel that circumstances had changed somewhat since the review application had been received, in as far as Lynn Birtwistle, the Designated Premises Supervisor, had been removed by the brewery, West Register (Public Houses III) Ltd aka Scottish & Newcastle; the brewery had become the premises licence holder; and the premises were currently closed awaiting the appointment of a new Designated Premises Supervisor. The Principal Solicitor reported that the brewery was agreeable to the conditions suggested by Lancashire Constabulary. In the light of the above, neither the constabulary, nor the brewery was required to attend the meeting. The Licensing Enforcement Officer reported that the brewery was currently in negotiations with a prospective designated premises supervisor who already ran a public house in the vicinity and was familiar with the suggested conditions and also with Challenge 21 policy. Having fully considered all the written representations made by Environmental Health and Public Health & Housing and a regular customer of the premises, the panel retired to reach its decision. The panel took into account the provisions of the Licensing Act 2003, the guidance issued in respect of it and the council?s own policy document. The panel was supportive of the conditions suggested by the constabulary but suggested that an additional condition relating to a Challenge 21 policy should be imposed. As no representative of the brewery was present the panel agreed that, to avoid the need to adjourn and reconvene the meeting, the Principal Solicitor should contact the solicitor acting on behalf of the brewery to ascertain whether the brewery would be amenable to this additional condition. The solicitor duly confirmed that this was the case. RESOLVED: that the conditions as set out below be imposed on the premises licence: - that a CCTV system be installed in accordance with the recommendations of the Crime Prevention Officer and be maintained and operated to the satisfaction of Lancashire Constabulary; - that customers be prevented from smoking, eating, drinking or congregating outside the premises other than in the area specified for this purpose; - that the outside walled area be kept clear of obstruction and no items that could be used to commit crime or cause damage be kept or stored in the area; - that staff be trained in responsible alcohol retailing, and - that a minimum of a Challenge 21 Policy be adopted. |
