The Licensing Panel considered an application by Lancashire Constabulary for a review of a premises licence under Section 51 of the Licensing Act 2003. This application was in respect of JS Food and Wine, 41 Moss Lane, Leyland.

At the start of the proceedings the police requested that the panel agree to an amendment to the review application.

This was in so far as, an application had subsequently been submitted to the licensing authority for the transfer of the premises licence to a Mr Mathavan and that he also be the designated premises supervisor. There had not been any representations and this would take effect the next day. Although it was anticipated Mr Mathavan would not be able to take up residence at these premises for about a further week.

The police now had confidence that the premises would be managed satisfactory in the future and requested the panel consider attaching the following conditions to the premises licence. Also whether, this licence should be suspended pending Mr Mathavan taking residence.

- that a CCTV system be installed in the shop and be maintained and operatorated to the satisfaction of Lancashire Constabulary and be available on reasonable request to inspection by any officer from a responsible authority;
- that a Challenge 21 Policy be implemented;
- that all staff be trained in age related sales and details of which be available on reasonable request to inspection by any officer from a responsible authority; and
- that a documented Refusal Register be maintained on the premises and this be available on reasonable request to inspection by any officer from a responsible authority.

With the permission of the panel and in accordance with the council?s hearing procedure, the Licensing Officer introduced the application. The owners of the premises (accompanied by his representative) then addressed the panel and questions were asked. Local residents who had made representations on the matter then addressed the panel and questions were asked.

Having fully considered all the representations (written and oral) made by local residents and the owners of the premises, the panel retired to reach its decision.

The panel took into account the provisions of the Licensing Act 2003, the guidance issued in respect of it and the council?s own policy document.
RESOLVED:
1. that the premises licence not be suspended; and
2. that subject to the additional conditions as set out below no further action be taken in respect of the premises licence for JS Food and Wine, 41 Moss Lane, Leyland on this occasion.
