(Councillor P J Smith declared a personal interest in this item as some of his relatives were members of the club; he only attended to observe, he did not take part in the meeting and decided to remain in the public seating area in the room.)

The Licensing Panel considered the application for the grant of a Premises Licence submitted under the Licensing Act 2003.

With the permission of the panel and in accordance with the council?s hearing procedure, the Licensing Officer introduced the application. The applicant (accompanied by his representative) then addressed the panel and questions were asked. Local residents objecting to the application then addressed the panel and questions were asked.

Having fully considered the representations (written and oral) made by local residents and the application made by the applicant, the panel retired to reach its decision.

The panel took into account the provisions of the Licensing Act 2003, the guidance issued in respect of it and the council?s own policy document.
RESOLVED: that the application be granted subject to the imposition of the mandatory conditions, those conditions which are consistent with the operating schedule and the conditions as set out in the following schedule.

Licensing Panel on the 7th August 2008 held a hearing in respect of an application from the Committee of Penwortham Lawn Tennis Club for a premises licence under Section 17 LA03 for the sale of alcohol, provision of regulated entertainment at Penwortham Lawn Tennis Club, Blackhurst Avenue, Hutton, Preston, PR4 4BG.

The panel made the following decision:

The panel decided to impose additional conditions on the licence:-

1. The club will adopt a ?Challenge 21? policy in respect of sales of alcohol and anyone engaged in the sale of alcohol will be trained in its use.

2. Whenever regulated entertainment is taking place the club staff shall maintain a log of all noise assessments that have been carried out; they shall also maintain a log of any other incidents that may take place at any time when the premises are open.

3. The club shall arrange regular liaison meetings with the residents in the vicinity to discuss any issues/problems which may emerge with the operation of the licence and to seek ways to resolve any such issues/problems amicably.

4. The club shall do everything reasonably practicable to ensure that taxi drivers should not sound their horns when collecting customers.

5. The club shall do everything reasonable practicable to keep the outside area of the tennis club in a clean and tidy condition.

The panel considered that the concerns of interested parties centred on public nuisance and the protection of children from harm, could be adequately addressed through the imposition of conditions consistent with the operating schedule together with those additional conditions listed.
