64 Housing Capital Programme - Reoccupation of Empty Properties

Councillor Hughes Cabinet member for Strategic Planning introduced this item which provided Cabinet with an overview of the work being undertake to support the reoccupation of empty properties across the Borough. The report recommended the use of Housing Capital Programme monies to support the extension of the ?A Place to Live? scheme, which is a partnership project with Methodist Action.

Councillor P Smith commented on the length of time some of the properties remained empty and the Leader informed Cabinet that she was pleased to this to see this being taken forward.

Councillor Wharton thanked Councillor Michael Green for his earlier work on this, who in turn thanked the officers involved and was pleased to see it moving forward.

RESOLVED (unanimously):

1. That the work that is ongoing in relation to the reoccupation of empty properties, and related performance information be noted.

2. That authority be to enter into an agreement with Methodist Action North West for the purposes of providing ?A Place to Live? Scheme.

3. That expenditure of ?100,000 Housing Capital Programme monies for the ?A Place to Live? scheme be approved.

65 Car Parking Schemes and Improvements

Councillor Mullineaux Cabinet Member Neighbourhoods and Street Scene introduced this report which detailed a number of proposed improvements to car parking across the borough including improvements to the Council?s own car parks and enforcement for both on and off street parking. The report also detailed estimated income projections and issues to consider should, following consultation, car parking charges be introduced at Worden Park and Withy Grove Park.

The report also referred to positive discussions with LCC on car parking enforcement and the agreed position that the two councils would combine existing fixed resources for both on and off street enforcement and operate a pilot enforcement scheme.

Councillor Foster questioned what the consultation would be on as the report added little to earlier reports and merely listed all the Council?s carparks.

In answer to that and to other members questions on the consultation process Councillor Mullineaux indicated that the consultation included all carparks to gather comments on all the Council?s carparks and that as indicated in the report it was proposed that the consultation process would include proposals for car parking charges at Worden Park and Withy Grove Park, arrangements for dealing with any vehicle displacement from Worden Park and Withy Grove Park, arrangements for Leisure Centre customers at Withy Grove, any additional on-street enforcement requirements, improvements and management arrangements for other council car parks.

He also confirmed that the consultation process would include the council website, engagement with local residents, partners and members, clip board surveys and My Neighbourhood Forums.

Following the conclusion of the consultation process a further report with detailed proposals would be presented to Cabinet.

RESOLVED (unanimously):

1. That the pilot enforcement project with LCC be introduced at the earliest opportunity.

2. That the consultation process for the proposals as outlined in the report be commenced

66 Worden Park Overflow Car Park Extension

Councillor Mullineaux Cabinet Member Neighbourhoods and Street Scene introduced this report which sought approval to accept the most economically advantageous tender for the proposed extension to the reinforced grass overflow car park on Worden Park.

Councillor Michael Green welcomed the report and the investment in Worden Park.

RESOLVED (unanimously): That Tender Number 11 in Table 1 be accepted for the construction of the overflow car park on Worden Park.

67 Introduction of Fixed Penalty Notices for Fly Tipping

Councillor Mullineaux Cabinet Member Neighbourhoods and Street Scene introduced this report which informed members that regulations had recently been introduced which granted new powers to local authorities to issue fixed penalty notices (FPN) for small scale fly tipping. Previous powers had required local authorities to enforce both small and large scale fly tipping through prosecutions.

The report detailed the recent changes to the regulations and proposed the adoption and level of charge for the new Fixed Penalty Notices.

In answer to a number of questions Councillor Mullineaux informed members that the Council was reliant on the public to bring instances to our notice and that the FPN did not relate to private land as that was the responsibility of the land owner. He also confirmed that no additional resources were being put into this and that no additional training was required. He also agreed that a certain amount of investigative work was undertaken but it was often difficult to trace those responsible.

RESOLVED (unanimously):

1. That the national FPN for small scale fly tipping in accordance with the Unauthorised Deposit of Waste (fixed penalties) Regulations 2016 be adopted.

2. That the level of a FPN charge for small scale fly tipping be set at ?400 to be reduced to ?200 if paid within 10 days of issue.

68 Standing Order No. 38 Delegation of Urgent Decisions between Meetings of the Cabinet or a Committee

It was reported that the Chief Executive in consultation with the Cabinet Member for Regeneration and Leisure and the Chairman of Penwortham Neighbourhood Forum gave permission, under SO. 38, to spend core funds allocated to the Penwortham Neighbourhood Form to support Penwortham Live 2016

70 Exclusion of Press and Public

The member of the public read a statement suggesting that as a ?ratepayer? he should be entitled to know, what land it is, if it?s on the council?s land register, the method of sale, etc. and did not believe that such matters should be confidential and that the whole question of confidentiality should be considered by Governance Committee.

Cabinet noted the statement.

Following the conclusion of the meeting Councillor Michael Green informed Cabinet that Helen Joanne "Jo" Cox Member of Parliament for the Batley and Spen Constituency had today been attacked and shot in her constituency and had sadly died.

Members of Cabinet and those present stood for a minutes silence as a mark of respect.
