Further to minute no. 17 (20 June 2017), the Planning Committee reconsidered a report on both its revised terms of reference for the committee and on new guidance on public participation.

The Legal Services Manager presented the report and highlighted a couple of minor changes under section 5.5 of the committee?s Terms of Reference. The Legal Services Manager added that the Governance Committee had considered this report at its meeting on 28 June 2017 and there was a suggestion made that borough/ward councillors should be invited to make representations after the applicant/agent had stated their case. The Governance Committee also suggested that the term used for the length of time allowed for each party should be consistent.

UNANIMOUSLY RESOLVED:

That ?

1. the comments made by the Governance Committee be noted.

2. subject to the minor changes reported at the meeting, the draft Terms of Reference for the Planning Committee at Appendix B together with the Guidance on Participation by the Public & Members of the Council at Planning Committee at Appendix C be agreed.

3. this now be recommended for approval to the Council meeting to be held on 19 July 2017.

2. That by virtue of its height, scale and design the proposal garage extension would negatively affect the character and appearance of the host dwelling and would appear overly prominent in the street scene and as such would be contrary to Policy G17 of the South Ribble Local Plan 2016 and South Ribble Residential Design SPD Design Guidance Note: DG01 Points A and G.

1. The development would result in an unacceptable level of noise and disturbance to neighbouring residential properties and the applicant has failed to demonstrate that the proposed noise mitigation measures are adequate to overcome the adverse impacts caused by noise. The proposal would be seriously detrimental to residential amenity and therefore, is contrary to Policy 17 criteria c) and d) in the Central Lancashire Core Strategy.

2. The proposed 3m high acoustic fence along the boundary with the adjacent residential property 246 Liverpool Road, will have a detrimental impact on the residential amenity of the occupant of that property by virtue of its size, scale and proximity. Additionally, due to the location of the 3m high acoustic fence, it will have a detrimental impact on the character and appearance of the area, contrary to Policy G17 in the South Ribble Local Plan.
