Appeal Decisions Jonathan Noad, Planning Manager, referred to an appeal for 17 Holland Avenue, Walton-le-Dale (planning application 07/2016/0519/HOH) for a part single and part two storey extension to the property. The Inspector dismissed the appeal but did comment that a smaller extension may be acceptable. The Planning Manager also referred to a recent Public Inquiry concerning the Penwortham Mills site (planning applications 07/2010/0648/FUL and 07/2014/0190/ORM). He stated that in August 2015 planning permission was granted for the development of the former Penwortham Mills site with access to be obtained from the Cross Borough Link Road. In addition, planning permission for an alternative access by either a priority junction or a roundabout had also been refused. Bovis Homes had originally appealed against the refusal for both alternative access arrangements but subsequently withdrew the appeal on the roundabout. Immediately prior to the Inquiry being heard the appellant had revised the priority junction to such an extent that the County Council?s Highway concerns had been nullified and on that basis the Inspector allowed the appeal. The Planning Manager stressed that this decision was entirely separate from the one for the Cross Borough Link Road and the implications of the decision had been mis-reported in the media. |

Planning Application 07/2016/0727/OUT - Longton Equestrian Centre, Chapel Lane, Longton Report (362K/bytes) attached Update (109K/bytes) attached Address: Longton Equestrian Centre, Chapel Lane, Longton, Preston, PR4 5NA Applicant: James Ainscough Development: Outline application for the erection of 6no detached dwellings following demolition of existing equestrian centre buildings following demolition of existing stable buildings (Access and layout applied for) RESOLVED (10 Yes, 1 No, 0 Abstention): Approved with Conditions. CONDITIONS: 1. An application for approval of reserved matters must be made no longer than the expiration of three years beginning with the date of this permission and the development must be commenced not later than the expiration of two years from the final approval of the reserved matters or, in the case of approval on different dates, the final approval of the last such matter to be approved. 2. No development shall commence until approval of the details of the Appearance, Landscaping and Scale hereinafter called "the reserved matters", has been obtained from the Local Planning Authority in writing. An application for the approval of the reserved matters shall be made to the Local Planning Authority before the expiration of 3 years from the date of this permission. 3. The development, hereby permitted, shall be carried out in accordance with the submitted approved plans Dwg 15-037 SL02 Proposed Site Layout 4. Foul and surface water shall be drained on separate systems 5. Prior to commencement of any development, a surface water drainage scheme, based on the hierarchy of drainage options in the National Planning Practice Guidance with evidence of an assessment of the site conditions shall be submitted to and approved in writing by the Local Planning Authority. 6. Prior to occupation of the first dwelling hereby approved, a sustainable drainage management and maintenance plan for the lifetime of the development shall be submitted to the local planning authority and agreed in writing. The sustainable drainage management and maintenance plan shall include as a minimum: 7. The development hereby approved shall be carried out in accordance with the recommendations for biodiversity enhancement measures contained in the submitted Ecological Survey and Assessment by ERAP Ltd dated December 2015. 8. That any tree felling, vegetation clearance works, demolition work or other works that may affect nesting birds shall not take place during the nesting season, normally between March and August, unless the absence of nesting birds has been confirmed by further surveys or inspections and written approval has been given from the Local Planning Authority. 9. No development shall take place (including demolition, ground works, vegetation clearance) until a construction environmental management plan (CEMP: biodiversity) has been submitted to and approved in writing by the local planning authority. The CEMP (Biodiversity) shall include the following. 10. No development shall take place, including any works of demolition, until a Construction Management Plan has been submitted to, and approved in writing by, the Local Planning Authority. The approved Plan shall be adhered to throughout the construction period. The Plan shall provide for: 12. Prior to the importation of any subsoil and/or topsoil material into the proposed development site, a Desk Study shall be undertaken to assess the suitability of the proposed material to ensure it shall not pose a risk to human health as defined under Part IIA of the Environmental Protection Act 1990. The soil material shall be sampled and analysed by a Competent Person. The details of the sampling regime and analysis shall be submitted to and agreed in writing by the Local Planning Authority prior to the work taking place. 13. The Reserved Matters submission for the details design of the development shall include the glazing/ventilation units specified within the AB Acoustics report dated July 2015 and these shall be installed during the construction phase of the development. 14. The Reserved Matters submission shall include details of the northern and eastern perimeter boundary fencing. The fencing shall be based on the acoustic fencing specified within the AB Acoustics report dated July 2015. The agreed acoustic fencing shall be installed prior to first occupation of the residential development and shall be retained and maintained at all times thereafter. 15. Electric Vehicle recharge points shall be provided to every property during the construction process. This shall consist of, as a minimum a 13 amp electrical socket located externally (or in the garage if available) in such a position that a 3 metre cable will reach the designated car parking spaces. A switch shall be provided internally to allow the power to be turned off by the residents. 16. As part of the Reserved Matters application, a Tree Constraints Plan which details all trees to be retained on site, shall be submitted to the Local Planning Authority for approval in writing. The details shall also include a Tree Protection Plan to demonstrate the root protection areas for all trees to be retained on site and shall be in accordance with BS5837 2012. 17. Before any site activity (construction or demolition) is commenced in association with the development, barrier fencing shall be erected around all trees to be retained on the site as detailed in the Tree Protection Plan which has been agreed by the Local Planning Authority. The fencing shall be constructed and located in compliance with BS 5837 2012 - Trees in Relation to Design, Demolition and Construction - Recommendations. Within these fenced areas no development, vehicle manoeuvring, storage of materials or plant, removal or addition of soil may take place. This includes ground disturbance for utilities. The fencing shall not be moved in part or wholly without the written agreement of the Local Planning Authority. The fencing shall remain in place until completion of all development works and removal of site vehicles, machinery, and materials in connection with the development. 18. As part of the Reserved Matters submission, details of the timescales for demolition of the existing buildings, the clearance of the area and the reinstatement of the land to green field shall be provided. The details to include a planting schedule for the area and a scheme for the maintenance and management of the green field area. The agreed scheme shall be implemented within the timescales set out. 19. For the duration of the development hereby approved, the public right of way access road must be kept clear of all construction vehicles associated with the development and the public right of way access road must not be used for the parking of any construction vehicles at any time. |

No work shall be commenced until satisfactory details of the colour and texture of the facing and roofing materials to be used have been submitted to and approved by the Local Planning Authority. 4 Prior to the commencement of the development hereby approved a scheme for the disposal of foul water shall be submitted to and approved in writing by the Local Planning Authority. Once works commence on the site, should site operatives discover any adverse ground conditions and suspect it to be contaminated, they should report this to the Site Manager and the Contaminated Land Officer at South Ribble Borough Council. Works in that location should cease and the problem area roped off. A Competent Person shall be employed to undertake sampling and analysis of the suspected contaminated materials. A Report which contains details of sampling methodologies and analysis results, together with remedial methodologies shall be submitted to the Local Planning Authority for approval in writing.
