55 Application for New Private Hire Drivers Licence - Driver A

A report was submitted regarding an application that had been made for a Private Hire Driver?s License. The applicant and his employer attended the meeting and addressed the Committee. The Committee also received representations from the Council?s Licensing Manager.
The Committee RESOLVED (UNANIMOUS): to refuse the application. The Committee did not find Driver A on the balance of probabilities to be a fit and proper person to hold a Private Hire Driver?s Licence

56 Complaint of assault/ theft - Driver B

A report was submitted regarding a complaint that had been made against Driver B. The Committee considered representations from the Council?s Licensing Manager, the Driver and his Employer who was attending in support. A number of additional documents were produced by the driver and these were circulated to the Committee at the meeting, together with copies of the complaints. It was decided that an earlier complaint on Driver B?s record would not be taken into account by the Committee. In the meeting the Committee offered the driver an adjournment to afford him the opportunity to seek legal advice but the driver refused this offer. The Committee RESOLVED (Unanimous) to allow the Driver to continue to hold his Hackney Carriage Drivers Licence.

The Committee considered representations from the Council?s Licensing Manager, the Applicant (in parts through his interpreter) and his legal representative. The Committee were also provided with six character references by the applicant.
The Committee RESOLVED (Unanimous) to refuse the application, that on the balance of probabilities, the Applicant is not a fit and proper person to hold a Hackney Carriage Driver?s licence.

The Committee RESOLVED (FOR: 9, AGAINST: 1, ABSTAINED: 1) that the Private Hire Driver?s Licence be REFUSED on the balance of probabilities the Applicant is not a fit and proper person.
