RESOLVED (UNANIMOUS): that the press and public be excluded from the meeting during the consideration of the following items of business as it involved the discussion of information which was defined as exempt from publication under paragraphs 1 and 2 (information relating to an individual and information which was likely to reveal the identity of an individual) of Part I of Schedule 12A of the Local Government Act 1972 and in which the public interest in maintaining the exemption outweighed the public interest in disclosing it.

42 Private Hire Driver?s Licence: Mr Khan

A report was submitted concerning the holder of a?private hire driver?s licence.

The holder of the licence, Mr Khan, attended the meeting and addressed the committee.

RESOLVED (UNANIMOUS): that ?

?

1.?as the protection of the public is the paramount consideration, it be noted that ?

?

(a) Mr Khan knew it was a requirement of holding a vehicle licence that the correct insurance should be in place. Despite this knowledge he did not ensure the vehicles was insured or was reckless as to whether insurance was in place;

(b) between 11/12/13 and 20/12/13 Mr Khan did not have insurance and despite that he continued to work as a taxi driver and undertook some 119 journeys putting lives at risk;

(c) Mr Khan did not inform his insurers of this change of address and therefore the committee felt that Mr Khan?s submission that he was unaware the policy had been cancelled could not be taken into account;

(d) whilst the committee had sympathy with Mr Khan?s personal and financial circumstances it did not detract for his responsibility to ensure that his vehicle was properly insured;

(e) the committee wished to point out to Mr Khan that it was his responsibility to ensure insurance was in place not the insurers, finance company or people living at what was his home address; and

(f) the committee therefore felt that Mr Khan was no longer a fit and proper person to hold a Private Hire Drivers Licence.

2. for the reasons as set out in 1 above, Mr Khan?s private hire driver's licence be revoked.
